Official Rules

MAXWELL HOUSE “LOCAL HEROES” CONTEST OFFICIAL RULES

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED OR RESTRICTED. ALL PRIZES WILL BE AWARDED. All federal, state, and local laws and regulations apply. Open and offered only to legal residents of the continental United States and the District of Columbia, age 21 or older at time of entry.

This Contest (“Contest”) begins at 12:00:01 a.m. Central Time on April 23, 2008 and ends at 11:59:59 p.m. Central Time on June 18, 2008. Electronic entries must be received by 11:59:59 p.m. Central Time on June 18, 2008, and mailed entries must be postmarked by June 18, 2008 and received no later than June 25, 2008.

HOW TO ENTER BY MAIL: Each entrant must submit a typed or legibly written description of the person he/she is nominating and what makes that person a hero. Entry must be 100 words or less to be eligible. Entry must include the entrant’s first and last names, address and telephone number, the name of the person the entrant is nominating and what makes that person a hero. To enter via mail, submit your entry to: American Profile/Maxwell House – Local Heroes, American Profile Magazine, 341 Cool Springs Blvd., Suite 400, Franklin, TN 37067.

HOW TO ENTER ONLINE: To enter electronically, access the website at www.AmericanProfile.com and follow the instructions. Entries submitted via email or facsimile are prohibited. Limit one entry per household or email address. In the case of multiple entries, only the first entry will be accepted. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the holder of the email account. Publishing Group of America, Inc. (“PGA”) is not responsible for technical failures in entry transmission, or lost, late, misdirected, damaged, incomplete, illegible or postage due mail. By participating in this Contest, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of PGA, and warrants that she/he is eligible to participate in this Contest. Any submissions that do not conform to the guidelines or are received after the deadline will be discarded and deemed VOID. No changes to any entries will be permitted once submitted. All entries become the property of PGA and will not be acknowledged or returned. The odds of winning any prize will be the same by means of mail entry as by online entry.

ORIGINAL WORK: Each entrant represents and warrants that his/her submission is an original work and that the entrant is the sole author with the full power to submit the same and to grant the above licenses to PGA. Entrants may not submit information or pictures that violate the property rights of others, including unauthorized intellectual property, images, trade secrets or other confidential proprietary information of a third party. Each entrant hereby waives any opportunity or right to inspect or approve his/her submission and/or the final product in which it may be used or incorporated. Each entrant hereby releases PGA from all claims now and hereafter existing which may arise under these Official Rules or from any use, non-use or editing of the entrant’s submission. By submitting an entry to PGA, entrants grant to PGA a perpetual, revocable, nonexclusive, royalty-free license to use, modify, create derivative works from, display, distribute and publish the submission in any media now known or hereafter developed.

PRIZES: One (1) Grand Prize winner’s hero will receive (i) a gift certificate for $500, (ii) a gift certificate for $500 made out to the hero’s charity of choice, and (iii) an American Profile Hometown Heroes book. Except where prohibited, the winning hero and/or the winning entrant’s description of the hero may appear in American Profile magazine and on AmericanProfile.com. Approximate retail value of the Grand Prize is $1,013. Four (4) First Prize winners’ heroes will each receive (i) a gift certificate for $250, (ii) a gift certificate for $250 made out to each hero’s charity of choice, and (iii) an American Profile Hometown Heroes book. Approximate retail value of the First Prize is $2,052 ($513 per First Prize winner). The value of the prizes set forth above represents PGA’s good-faith determination of the retail value thereof. No prize is transferable or redeemable for cash. PGA reserves the right to substitute a prize with one of equal or greater value in the event prize is unavailable. Federal, state and local taxes shall be the responsibility of each winner. All prizes will be fulfilled by PGA no later than August 31, 2008.

ELIGIBILITY: Employees and directors of Kraft Foods Inc. (“Maxwell House”) and PGA, their vendors, affiliates, or subsidiaries, and their immediate family members and residents of their households, are ineligible to participate.

JUDGES AND CRITERIA: Each eligible entry will be judged by a panel of American Profile editors selected by PGA. Entries will be judged based on the following criteria: (i) the activity or activities in which the hero described in the entry is involved; (ii) the hero’s level of involvement in the activity; (iii) the duration of the hero’s involvement in the activity; and (iv) the hero’s measurable impact on his/her community (the “Criteria”).

WINNERS: The winning heroes will be selected from all eligible entries received by PGA. Judging will take place on or about June 30, 2008. All winners will be notified by postal mail. The Grand Prize winner, First Prize winners, and the winning heroes, where permitted, will be required to complete and return an Affidavit of Eligibility/Release of Liability, which must be signed and received by PGA or its designated agent within fourteen (14) days of date of notification, or such winner may be disqualified and the prize awarded to the next highest prize winner or an alternate winner selected by the judges from among the remaining eligible entries. If any prize notification letter or any prize is returned as undeliverable, the prize will be awarded to the next highest prize winner or an alternate winner will be selected by the judges from all non-winning entries.

Acceptance of a prize constitutes permission (except where prohibited) to use the winner’s and hero’s name, hometown, and likeness for purposes of advertising and publicity without additional compensation.

DISQUALIFICATION: The use of robotic, automatic, macro, programmed or like methods (including, without limitation, the use of any promotion/sweepstakes subscription, notification, entry or like sites or service that offers sweepstakes entry services “on behalf of” entrant) is strictly prohibited. Persons found tampering with or abusing any aspect of this Contest, as solely determined by PGA, will be disqualified. If disqualified, PGA reserves the right to terminate the person’s eligibility to participate in this and future promotions and sweepstakes of PGA. PGA reserves the right to cancel the Contest if it becomes technically corrupted.

RELEASE AND INDEMNIFICATION: By entering, entrant acknowledges that neither PGA nor Maxwell House have made nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the prizes. By participating, entrant releases and agrees to hold harmless PGA, Maxwell House, their respective officers, directors, employees, parents, affiliates, subsidiaries, advertising, promotion, fulfillment, marketing agencies, public relations firms, consultants and contractors from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons (including death) and property that may be sustained in connection with the receipt, ownership, possession, acceptance, enjoyment, use or misuse of a prize, or arising out of participation in the Contest. By entering the Contest, entrant agrees to indemnify and hold PGA and Maxwell House harmless from and against any and all losses, damages, and actions of any kind arising from any claim that entrant’s submission infringes the intellectual property rights or other proprietary rights of a third party.

DISCLAIMER; LIMITATION OF LIABILITY: IN NO EVENT WILL PGA, MAXWELL HOUSE, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, SUBSIDIARIES, ADVERTISING, FULFILLMENT, MARKETING AGENCIES, PUBLIC RELATIONS FIRMS, CONSULTANTS OR CONTRACTORS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF ANY ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES AWARDED IN CONNECTION WITH THE CONTEST, INCLUDING WITHOUT LIMITATION, ANY CLAIMS BASED ON PUBLICITY RIGHTS OR INVASION OF PRIVACY. No responsibility is assumed by PGA for lost, late, incomplete, stolen, misdirected, mutilated, postage-due, illegible, inaccessible, corrupted or unusable entries; incorrect or inaccurate online or printed information relating to the Contest (including typographical errors); any computer, telephone, cable, network, Internet or other hardware or software malfunctions, failures, connections or availability; or unauthorized human intervention. GENERAL: The state and federal courts located in Nashville, Tennessee shall have exclusive jurisdiction of any controversies regarding this Contest, and the laws of the State of Tennessee shall govern the Contest. Each entrant waives any and all objections to jurisdiction and venue in these courts and hereby submits to the jurisdiction of those courts. Any and all lawsuits or other disputes that arise relating to this Contest must be filed within one (1) year from the date that the winners are drawn. The failure of PGA to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision. If any part of these Official Rules is held by a court of competent jurisdiction to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remainder of these Official Rules will remain fully in force. Requests for winners lists received after July 31, 2009 will not be honored. Residents of WA and VT may omit return postage.
